Transgender widow's marriage debated at hearing

WHARTON, Texas — Attorneys for the family of a southeast Texas firefighter killed last year are pressing a judge to void his marriage to his transgender widow, arguing she was born a man and Texas doesn't recognize same-sex marriages.

During a court hearing Friday, attorneys for the family of Thomas Araguz III asked a judge to rule in favor of their lawsuit that seeks control over death benefits and other assets totaling more than $600,000.

The firefighter's family says he only learned of his wife's gender history just prior to his death in July 2010 while battling a blaze.

But his widow, Nikki Araguz, has insisted her husband was aware of her history and says she will win the case.

State District Judge Randy Clapp was not expected to immediately rule.
