Mich. judge expected to rule today on gay-marriage ban

Lawsuit began as challenge to Michigan ban on adoption by unmarried couples.

DETROIT — A federal judge is expected to decide the fate Wednesday of Michigan's ban on gay marriage, either giving two women the right to pursue their dream of having a family or upholding the state's position that only men and women can marry and have children.

The issue has landed in the hands of U.S. District Judge Bernard Friedman, who in June refused to toss out a lesbian couple's lawsuit challenging the state's ban on adoption by unmarried couples. Friedman, citing the June U.S. Supreme Court decision that recognized legally married gay couples, concluded the plaintiffs are "entitled to their day in court and they shall have it."

That day is today.

At 2:30 p.m., a hearing on the matter is scheduled before Friedman, who is expected to decide on the constitutionality of Michigan's ban on gay marriage and determine whether or not the state is unlawfully discriminating against two nurses who want to get married and adopt each others' children.

If Friedman lifts the ban without issuing a stay, same-sex marriage would be legal in Michigan until, and unless, a higher court overturns it. If he doesn't, the status quo remains: no gay marriage in Michigan.

"We're cautiously optimistic that a ruling will come," said Dana Nessel, one of four lawyers representing the plaintiffs. "When you have waited this long for some semblance of equality, you kind of want it right now. You don't want to wait any longer."

Whatever Friedman decides, an appeal will follow from either side. The state has vowed a vigorous fight to uphold the 2004 voter-approved constitutional amendment that defined marriage as "the union of one man and one woman."

The state argues it has "legitimate state interests" in defining marriage as such.

"Michigan supports natural procreation and recognizes that children benefit from being raised by parents of each sex who can then serve as role models of the sexes both individually and together in matrimony," the state has argued in court documents.

The state also argues that Michigan voters have spoken on the issue of gay marriage and that their decision should stand.

"There is no fundamental right to marry a person of the same sex, and nothing in the U.S. Constitution requires or permits federal courts to invalidate a state's decision defining civil marriage as the union of one man and one woman," the state wrote in court documents.

The case involves April DeBoer, 42, and Jayne Rowse, 48, who in January 2012 challenged the state's ban on same-sex adoption. They later decided also to take on the the state's ban on gay marriage, which 59% of voters approved in 2004.

The plaintiffs argue the ban unlawfully violates their right under the Equal Protection Clause of the U.S. Constitution to get married and adopt each others' children. Rowse has two preschool-aged boys; DeBoer has a 3-year-old girl. They also argue the state has no rational basis for denying them the right to get married and adopt kids.

Meanwhile, Nessel believes that gay and lesbian community in Michigan has suffered long enough from discrimination. She believes a ruling favoring her clients could trigger long overdue positive changes for gays and lesbians the state that she contends has among the worst records for gay and lesbian rights.

"You can't go lower than what we have," Nessel said. "This is why it's so important for us to have a federal court ruling on this because the Legislature is not doing anything to protect this very vulnerable population of people

"It's very critical that we have a federal court step in and say, 'No, you cannot use your laws to discriminate against what has historically been an unpopular segment of society," she said.

To date, 14 states have legalized gay marriage, according to ProCon.org, a nonprofit and nonpartisan group that researches controversial issues. Another 35 states, including Michigan, have gay marriage bans through either laws or constitutional amendments. Only one state, New Mexico, has no law legalizing or banning same-sex marriage.

The New Jersey Supreme Court said it will soon decide whether gays can marry there, and a Utah federal judge in December will hear arguments about that state's ban.

In June, the U.S. Supreme Court issued two landmark same-sex marriage rulings: one directed the federal government to provide equal treatment to same-sex spouses, the other allowed gay marriages in California to resume.

In a 5-4 ruling, the nation's highest court struck down the 1996 Defense of Marriage Act, which denied federal benefits to gay couples married under state law. The court found that gay couples married in states where it's legal must receive the same health, tax, and other benefits offered to their heterosexual counterparts.

However, the high court rulings haven't deterred Michigan Attorney General Bill Schuette from fighting to uphold the state's constitutional amendment defining marriage as being between one man and one woman.

"The U.S. Supreme Court has ruled that states retain the constitutional authority to define marriage," said Schuette spokeswoman Joy Yearout. "We will continue to aggressively defend Michigan's Constitution in this case."

Gary Glenn, who leads the conservative American Family Association of Michigan, said it would be a mistake for a judge to extinguish a law on the books for nearly a decade.

"One Detroit lawyer in a black robe doesn't have the legitimate constitutional or moral authority to overturn the will of millions of Michigan voters," Glenn said.

In Ann Arbor, the Washtenaw County clerk's office said judges and clergy will be available at the local courthouse if Friedman allows same-sex marriage. The county will waive the typical three-day waiting period to get a license, at least on Thursday.

"There's obviously a lot of emotion, and a lot of people have been waiting a long time," said Ed Golembiewski, chief deputy clerk.

Bishop Jerry Brohl of Blessed John XIII Community, a church for Christians of all stripes in Wyandotte, near Detroit, said he's eager to bless same-sex marriages, even if he doesn't know the couple.

"Under normal circumstances, I'd want to spend a bit more time with a couple," he said. "But under these circumstances, I feel I need to make an exception. You have two mature persons who are committing themselves to a relationship based on love.

Congratulations New Jersey and Congratulations to all the BEAUTIFUL New Jersey Queerfolk who can now marry or not as they choose - just like real humans

I echo the comments of participants in this event. I can not believe this is happening in my lifetime. Forty-two years ago, as a member of Gay Liberation Front in Michigan, I heard the group leader planning a classroom talk. He was trying to figure out who the "straightest" acting member of the group was so he could send to the talk someone the presumed straight audience would find less offensive. As we have helped society begin to learn to accept us, we have also begun to learn to accept ourselves. There is still a long way to go on both of those fronts, but we are moving down that road. Some of us are stepping proudly, tossing our batons in the air and singing, others of us are being dragged along by our friends and loved ones. But we are moving, and society is moving.

I am so happy to have lived to see this day.

I look forward to the day when marriage equality is the law of the land.

Christie withdraws same-sex marriage challenge, as NJ recognizes unions

New Jersey Gov. Chris Christie on Monday withdrew his challenge to legalized same-sex marriage in the state, after a court determined that the appeal is not likely to prevail.

The decision by Christie came as, in response to the court move, the state on Monday began to recognize same-sex marriages. Christie's administration formally withdrew the appeal in a letter to the state Supreme Court.

"Although the Governor strongly disagrees with the Court substituting its judgment for the constitutional process of the elected branches or a vote of the people, the Court has now spoken clearly as to their view of the New Jersey Constitution and, therefore, same-sex marriage is the law," the governor's office said in a statement. "The Governor will do his constitutional duty and ensure his Administration enforces the law as dictated by the New Jersey Supreme Court."

Earlier in the day, gay couples exchanged vows in early morning ceremonies in several New Jersey communities as the state became the 14th state to recognize them.

The hastily planned first weddings to legally unite long-time couples were planned for a state Senator's grand home in Elizabeth, the boardwalk in Asbury Park and government buildings in small towns and big cities.

In the arts community of Lambertville, Mayor David DelVecchio led the ceremony to marry Beth Asaro and Joanne Schailey. He also presided when they joined in a civil union the minute they became recognized in the state in February 2007.

Soon after they cut the cake, DelVecchio handed Asaro a pink marriage license. "We're floating on air," she said. Added Schailey, "It's like winning the Super Bowl."

The couple, both wearing suits, hosted a reception attended by friends, family and several politicians. The song "In the Mood" played.

Asaro, a member of the city council in Lambertville, said they wanted to get married at the first moment, in part, to promote the gay-friendliness of their community north of Trenton.

"This shows to the world that Lambertville is open for business," DelVecchio said.

In Newark, Mayor Cory Booker was marrying the first of several couples when someone attempted to disrupt the ceremony.

Booker had asked if anyone had reason to object to the marriage and a protester screamed "This is unlawful in the eyes of God and Jesus Christ."

Booker, who was elected to the U.S. Senate last week, called for the person to be removed and police dragged him out.

As Booker continued speaking, "...not hearing any substantive and worthy objections," thunderous applause erupted.

The weddings came amid a flurry of legal activity after the U.S. Supreme Court ruled in June that the federal government should recognize gay marriages and confer couples with the same benefits that it does for heterosexual married couples, including joint tax filings, the right to live together in government-funded nursing homes and Social Security survivor benefits.

A state judge last month agreed with advocates who said that by allowing civil unions but not marriage, New Jersey was keeping gay couples in the state from legal equality.

The administration of Christie, a Republican and possible 2016 presidential candidate, had appealed both the ruling and Monday's implementation date to the state Supreme Court.

And on Friday, less than 60 hours before the weddings were to begin, the state's top court refused to delay them while it sorts out the overall case. The court said the state is not likely to prevail.

Many of the people who have long fought for the right for gay couples to marry had been bracing for a delay, even while they were optimistic the state's top court would ultimately force New Jersey to recognize same-sex marriage.

For the first couples to tie the knot legally, it's been a weekend of fast wedding planning and confusion.

Some towns began taking applications for same-sex marriage licenses on Thursday and continued even after the state government told them not to until there was clarity from the courts.

Other towns refused to grant licenses even after the state Health Department said Friday evening that towns should accept the applications.

It's expected that a rush of weddings will continue in coming days as couples are able to get licenses.

Hawaii Senate passes same-sex marriage bill

Bill now goes to the House; committee hearing scheduled for Thursday


HONOLULU —The Hawaii Senate voted Wednesday in a 20-4 vote to approve the bill to legalize same-sex marriage.

Democratic Sen. Clayton Hee said before voting for the bill that the moment is career-defining and lawmakers should embrace it.

Hee says Hawaii should expand its definition of aloha to truly include everyone regardless of sexual orientation.

The House plans to refer the bill later Wednesday to a joint committee hearing on Thursday. The hearing is likely to be jammed with public testimony, with the possibility of being extended to a second day.

The bill's prospects are far less certain in the House, though lawmakers and Gov. Neil Abercrombie have said they believe the measure has enough support to pass.

House Majority Leader Scott Saiki says it's likely the chamber will amend the bill to change religious exemptions. The Senate bill currently exempts ministers and other clergy from having to perform gay wedding ceremonies, but not for-profit businesses.

An Amazing confluence of newly attained rights. Same sex marriage becomes legal in New York, and "Don't Ask, Don't Tell" becomes illegal, so these young West Point Grads get married in the West Point Chapel.
I am amazed yet again at the progress that has been made in my lifetime. AMAZED.

Larry Choate III, class of 2009, married Daniel Lennox, class of 2007, before about 20 guests.
Choate, 27, taught Sunday school at the U.S. Military Academy's Cadet Chapel and said he always thought of it as the place he would get married if he could.
West Point hosted two same-sex weddings of women in late 2012, more than a year after New York state legalized gay marriage. But Saturday's wedding was the first time two men wed at West Point.
"It's maybe one more barrier that's pushed over a little bit, or maybe one more glass ceiling that's shattered that makes it easier for the next couple," Choate said Friday.
Choate and Lennox are out of the military and wore tuxedoes for the ceremony. Some of their guests were in uniform.
The 28-year-old Lennox is getting his master's degree in business administration at Harvard University. Choate is applying to Harvard's John F. Kennedy School of Government.
The pair did not know each other as cadets but met later through a friend.

The bill is on the way to the Governor who said if it passed he would sign it.

Today it was on the news that Texas court has DENIED same sex couples that were legally married in other states to become divorced in this state; saying that if they recognized their marriages from other states that it would interfere with the State Law in Texas that is against same sex marriage.... can't even get divorced in this state if you are same sex married couple living here from another state where your marriage is legal.
I don't know what it will take for my home state of Texas to just go ahead and do what the right thing is for us queer folk and let us have the choice of getting legally married or not like other states have done in the rest of these United States...........which I see as Divided States.

Marriage Equality in Hawaii Clears Another Hurdle; On to the Full House!November 5, 2013 by Adrian Matanza, Senior Regional Field Organizer HRC Blog

Just moments ago, after over 54 hours of testimony, the Hawaii House Committees on Judiciary and Finance amended and passed SB1, the marriage equality bill; 10 to 7 in Finance and 8 to 5 in Judiciary.

With over 5100 testifiers in support and opposition of the bill, SB1 was amended to include language that would provide protections to religious institutions. The bill now heads to the full House for consideration. While this is a huge hurdle in the passage of marriage equality in the Aloha State, the bill must pass the full House, then head back to the Senate, for the chamber to agree to the House’s amendments.

The House voted the second time yesterday and passed the marriage equality bill, but there is one more "reading" and vote tomorrow before the bill is sent back to the Senate for final voting.

One step closer....

An interesting side note is that one of Hawaii's openly Lesbian representatives voted no on the bill yesterday, saying that she is not sure it is what the people "really" want.

Today it was on the news that Texas court has DENIED same sex couples that were legally married in other states to become divorced in this state; saying that if they recognized their marriages from other states that it would interfere with the State Law in Texas that is against same sex marriage.... can't even get divorced in this state if you are same sex married couple living here from another state where your marriage is legal.
I don't know what it will take for my home state of Texas to just go ahead and do what the right thing is for us queer folk and let us have the choice of getting legally married or not like other states have done in the rest of these United States...........which I see as Divided States.

What it is going to take is for Section 3 of DOMA to be repealed. This, if I am not mistaken, is the section that says that states do not have to recognize perfectly valid same sex marriages, that are made in other states.

In my opinion, we did good in getting the Supreme Court to declare that one section of DOMA unconstitutional. The job isn't over with, though, until the whole law is found to be unconstitutional. This is going to take another lawsuit or three, I'm afraid.

Governor Pat Quinn will sign the bill on November 20 in a signing ceramony in Chicago. Marriage is scheduled to begin june 1st.

Why they have to wait so long wasn't mentioned, but each state has different effective dates for laws to go into effect.

The house is currently reading their opposition to the 19 (so far) amendments they made to the bill, and then there will be a final vote. I was watching the live stream from one of the Hawaiian news stations...the opposition is doing everything they can to derail the bill.

I'll be out later, i hope blackboot comes in to post the final vote.

Hawaii House lawmakers pass same-sex marriage bill


HONOLULU (HawaiiNewsNow) -

The Hawaii House of Representatives passed a third reading of an amended version of SB 1, the "Hawaii Marriage Equality Act of 2013" late Friday night.

The vote was 30 in favor and 19 against, with two representatives excused. the vote came after more than 20 floor amendments to the bill were attempted. Representatives also were allowed ten minutes to make final remarks, if they wished, before the final vote, which finally occurred shortly after 10 p.m.

Supporters of the bill screamed loudly in celebration when Speaker Joe Souki officially announced that the bill was approved. On the other side of the rotunda, opponents of the measure were silent for several minutes. Some also yelled in frustration that the bill had been approved.

SB 1, House Draft 1 expands the bill's original religious exemptions to protect clergy from refusing to perform wedding ceremonies and religious institutions from being compelled to allow wedding celebrations or provide wedding goods or services to a same-sex couple.

The bill now moves over to the Senate, where it is expected to be taken up Tuesday, November 12 (following the Veterans Day holiday). If the Senate approves the bill and Gov. Neil Abercrombie signs it, will go into effect December 2, 2013.

HONOLULU —The Hawaii Senate passed a bill legalizing same-sex marriage on Tuesday before sending the special session to Gov. Neil Abercrombie.
The bill allowing same-sex couples to wed starting Dec. 2 passed in a 19-4 vote with two lawmakers excused.

Senators took up the bill a second time because of changes made in the House, where the bill was amended and passed after a five-day public hearing and two lengthy floor sessions.

An estimate from a University of Hawaii researcher says the law will boost tourism by $217 million over the next three years.


Senate made two decisions Tuesday. First, senators decided to accept the amended bill from the House. After that, the final vote was taken.

Abercrombie has indicated he would sign the bill as currently written.

"In Hawaii, we believe in fairness, justice and human equality. We embrace the Aloha spirit and respect one another. Today, we celebrate our diversity defining us rather than dividing us,"said Abercrombie. "I believe this bill provides equal rights for all people, is legally sound, and is in accord with the Hawaii State Constitution. I look forward to signing this significant piece of legislation, which provides marriage equity and fully recognizes and protects religious freedoms."


President Barack Obama praised the bill's passage, saying the affirmation of freedom and equality makes the country stronger. He says the vote makes him "even prouder" to have been born in Hawaii.


Maui Democratic Sen. J. Kalani English said the bill is an "expansion of aloha in Hawaii."


Sen. Sam Slom, the chamber's only Republican, said the government should stay out of legislating marriage.


The Hawaii Republican Party released the following statement:

"The Hawaii Republican Party appreciates that so many people, on both sides of this issue, passionately participated in the hearing process on this bill. However, what Hawaii witnessed during this special session was unprecedented -- a democrat super majority side-stepped important issues like lowering the high cost of living for working class families or improving our keiki's education, and instead pushed through controversial legislation in just ten days. Governor Abercrombie and the Democrat political elite decided that Hawaii's people are unfit to vote on important issues. Citizens may have been denied the right to vote on this issue, but next November they will not be denied the opportunity to vote on who represents them."

I read where Governor Abercrombie might sign as early as tomorrow...that would make Hawaii number 15 before Illinois which won't be signing until 11/20, right?

In any event, it is wonderful that Hawaii (where this fight began 20 years ago in 1993) finally extends Aloha to all of it's residents.

At our church we have a karaoke night once a month. Last Friday, two beloved friends of ours, together 35 years, returned from their honeymoon. They went to Massachusetts where they married on their thirty fifth wedding anniversary October 28. One of our gentlemen members sang the Hawaiian wedding song and dedicated it to them.

Hawaii becomes 15th U.S. state to legalize gay marriage

HONOLULU (Reuters) - Hawaii's governor signed into law on Wednesday a bill extending marriage rights to same-sex couples, capping 20 years of legal and political rancor in a state regarded as a pioneer in advancing the cause of gay matrimony.

The new law, which takes effect on December 2, makes Hawaii the 15th U.S. state to legalize nuptials for gay and lesbian couples, rolling back a 1994 statute defining marriage as a union between a man and a woman.

"In Hawaii, we are all minorities, and we all deserve the same aloha," state Representative Chris Lee, a leading proponent of the measure, said before Governor Neil Abercrombie signed the bill.

Abercrombie said that despite misgivings by opponents who felt their religious beliefs were infringed, the measure served the "greater good" by more fully embracing gay and lesbian members of society, who had long felt marginalized.

"Now all those who have been invisible will be visible to themselves and the world," the governor said before sitting down at a table inside an auditorium of the Honolulu Convention Center near the city's beachfront Waikiki area to sign the bill, as supporters erupted in cheers.

The measure gained final approval from the Democrat-controlled state legislature on Tuesday, 15 days after the start of a special session called by Abercrombie, a first-term Democrat and former congressman, to consider the bill.

About a week before Hawaii lawmakers approved same-sex marriage, Illinois' General Assembly gave final approval to a gay marriage bill, but Illinois Governor Pat Quinn is not expected to sign that measure until later this month.

The ACT (Austrailian Central Territory) will begin to allow equal marriage this Saturday despite a ban on same-sex marriage nationwide. Basically the courts won't stop them despite federal objection.

In Utah today the Federal Courts are hearing a lawsuit brought by 3 same-sex couples challanging the States ban on equal marriage; a decision is expected in January.

A Court clerk in PA has petitioned to continue marrying same-sex couples despite a state wide ban.

In Illinios where equal marriage begins in June, a same-sex couple will be allowed to marry right away as one partner is dying and will not make it until June.

Utah was one of the first, if not THE first to ban same-sex marriage.

However, the Judge hearing the case is new, and was appointed by President Obama...which does not guarantee anything, except maybe a slight chance since the SCOTUS has ruled on parts of DOMA and Prop 8.

In the news today was "Oregon United for marriage", who gathered enough signatures to put equal marriage on the ballot in November 2014.

If sucessful at the voting booths, Oregon will be the first state where a ban on equal marriage in a state constitution is repealed by a vote of the people.

I personally don't feel people should vote on minority rights, but it is a step forword by a group that refuses to sit around and do nothing when faced with inequality.

Sad news from down under, as their high court has stopped all same-sex marriages in the Capitol territory, and has nullified about 2 dozen marriages.

Marriage in Austrailia is defined as one man one woman at the Federal level, and has been that way since 1961 according to what i read.

Breaking news......New Mexico became the 17th state (and at least 8 Native American Tribes) to be granted marriage equality by their Supreme Court.

Marriages prior to the ruling which have been occuring since August will be valid, and marriage can resume immediately.

Way to go New Mexico!

A Federal Judge has ruled that Virgina's ban on same-sex marriage is unconstitutional!!!

The judge also issued a stay on marriages pending all of the appeals that will surely come, but just as Prop 8 was eventually ruled as null and void, there is good reason to believe the Virgina ban will follow.

Actually, Ms T, I am pretty all right with the ban on ALL marriages in Oklahoma.
1) I would like to have non LGBTQ folk feel what it is like to be denied the benefits of marriage. Money is a big issue in any relationship, and losing some of their own money may motivate otherwise unmovable people to think about granting every one the financial privileges of marriage in order to get their own privilege back.
2) Sometimes stupid people can do things in such a stupid way, that even other stupid people can see how stupid it is. I think this bill might be just such an eye-opener.
3) Let straight people fuck up other straight peoples lives for a change instead of fucking up ours!

(CNN) -- Oregon will not defend the state's same-sex marriage ban in court because the law would not stand up to a federal constitutional challenge, the state's attorney general said Thursday.
However, Ellen Rosenblum said in legal documents that the state is legally obligated to enforce the state's ban on same-sex marriage while a federal lawsuit is litigated.
Oregon filed the documents in response to the lawsuit challenging the ban.
Oregon voters passed Measure 36 in 2004, which amended the state's Constitution to define marriage as between one man and a woman.
In 2013, the state's chief operating officer directed state agencies to recognize same-sex marriages that were legally performed in other states.
Thursday's response ended by saying the state will not defend the Oregon ban on same-sex marriage because it "cannot withstand a federal constitutional challenge under any standard of review."
Meanwhile, Rosenblum said officials are legally obligated to enforce the ban until the court makes a ruling.

Democratic Legislators changed part of the language of the bill before the final vote, so the Bill will not be eligible for vote again until 2016 due to Indiana's requirements of passing 2 sessions of the house and senate unchanged prior to voting. Complicated, sorry if i'm not clear.

In any case, a lawsuit has been filed in Indana by 2 couples challanging the current ban same sex marriage, so the law being considered might be a moot point if the Federal Judge strikes
down the current restriction as unconstitutional before the vote can be taken.

The Methodist Church dropped all charges against the Minister recently charged with breaking the laws of the church by preforming the marriage of his son to a man. In December another Minister was defrocked for doing the exact same thing; have the Methodists realized that things they are a changin'?

Today a Federal Judge struck down Michigan's constitutional ban on same-sex marriage, with no stay issued as to when marriages may begin.

As the ruling was handed down at the close of the court day, there was no time for marriage licenses to be issued, so unless there is an emergency stay issued over the weekend, marriage can begin Monday.

This is the first good political news coming out of Michigan since Fox news took over all the news outlets 30 years ago, and turned my progressive, liberal, always in the forefront on social and civil rights issues, home state, into a conservative wasteland. I hope they do start marriages right away, that will make this ruling irreversible unless further legislation takes place.

As i suspected...

Marriages will be on hold until at least Wednesday in order to give the State time to appeal the decision. But, in a happy turn of events, hundreds of people were able to get married before the temporary stay was put in place, as Democratic county clerks added Saturday hours so that people could begin to marry immediately!

Marriage equailty reigns in Arkansas, where the first of (hopefully) many marriages were performed today, and a total of 17 licenses were issued in one county. The AG has vowed to fight the ruling overturning the State ban, but so far no request has been filed. Stay tuned!

A Federal Judge has struck down Idaho's ban on same-sex marriage.

The courts just ruled that the National organization for Marriage (NOM h8ers), cannot defend the ban against same sex marriage in court in the place of the Governor, who refuses to justify hate. The decision whether or not to strike down the ban should come any day.

Meanwhile in Idaho, the Judge who struck down their ban is refusing to issue a stay, and in the event the 9th district (federal) court will not step in and stay the order, marriages in Idaho will begin Friday.

The 9th district court is the same one that left California hanging with a stay for so long, so unless they have changed i see a stay ahead for Idaho as well.

In other Arkansas news, the judge that overturned the ban originally, has now overturned all laws that pertain in any way to same-sex marriage, due to a Federal Court saying he had not gone far enough in his decision. As of 1 hour ago, Pulaski county is the ONLY county issuing licenses, as the other counties are refusing to do so because they are "confused".

A Federal Judge just overturned Oregon's same-sex marriage ban, and the first licenses have been issued.

There should not be a stay issued, as neither the Governor of Oregon or the Attorney General will ask for an appeal, and the hate group NOM has been denied the right to appeal.

The State of Utah was ordered by a Federal Court today to declare the 1200 same-sex marriages done before their stay was put in place, to be valid.

Utah tried to declare the marriages as not valid, but to do so would create hardship and distress to those couples married during the brief time it was legal.

Just a thought...there are 18 states and the District of Columbia which now allow equal marriage, and with the others in limbo (Utah, Texas, Arkansas, Idaho, Oklahoma-->8-9 total) awaiting final outcomes, by the end of the year there could be half more/less of the states having passed marriage equality. The final half i see over the next 5 years unless the United States Supreme Court steps in and makes a blanket law for all.

There are States where you can still be fired for being gay, and/or be denied housing and other services, and although equal marriage will help, other laws must be changed as well for our brothers and sisters to have a chance at real equality.

Pa is a progressive state as far as the majority here. When polled on the rights of same sex marriage my state is in favor at about 50% :) I would say IMOP our Gov will not file a stay and appeal this.

I have followed this, and whats funny is after the Supreme Court rulings on DOMA and Prop 8 being struck down, there were organizations that approached her (Kathleen Kane our Attorney General) to fight to keep the ban, her response was something to the effect of: She has no intentions to waste the resources of Pa on fighting this, although it is her personal belief that same sex marriages should be allowed, she felt our public resources would be better spent elsewhere!! So very minimally, and without much effort there was some movement, but it was just to bide the time for this PA court ruling in which she was in the "know" of what the end result would be. How sweet it is that Pa residents can sing.......going to the chapel and I'm gonna get married!! And have it recognized as legal!

The Governor just announced that he will not appeal the decision to allow marriage equality. So....marriages may commense thurs/fri (3 day waitng period after license received), and all marriages done outside of Pennsylvania are to be recognized by the state immediately.

Today, The US Supreme Court denied the request of the NOM haters to stay marriages in Oregon while it is decided if NOM can defend the ban in court as the Governor refuses to do so.

A really positive step.

**A side note...so far when hate groups have tried to become involved in these lawsuits, it has been ruled that they cannot, as same sex marriage does not effect their marriages in any way.

The ban was struck down today, and licenses were being issued in several counties. This makes the 27th state were marriages can be performed or are stayed pending appeals.

The Attorney General will be filing an emergency motion for a stay, but as of 2 hours ago things were moving forward. Several Churches were offering to perform ceremonies for those that wanted to drop by Monday.

The 10th District Court of appeals (3judge panel) just confirmed that Utah's ban on same-sex marriage is unconstitutional, as per the recent decision by a Federal Judge which was appealed by the state.

Utah may now request a full court review (which the court can refuse), or they can proceed directly to the US Supreme Court, which could also refuse to hear the case and the decision would stand.

Personally, being that it is Utah, i think they will go the route that will tie-up marriage equlity the longest.

Marriage Equality is now official in California, with Governor Brown's signing of Senate Bill 1306 sponsored by Sen. Leno.

The Bill was needed for minor changes to the wording of husband and wife (instead using spouse and spouse), and one man-one woman replaced by two adult persons.

Well it's official!

Utah has asked the US Supreme Court to decide the issue of marriage equality.

They (Supreme Court)can take up the case (which i expect) or they can decline which would make same-sex marriage legal in Utah, but would not decide other pending cases.

The Florida same-sex marriage ban was overturned for Monroe county (keys) only, with a decision on the lawsuit i mentioned before due very soon.

Even though the Federal Judge said marriage in Monroe County must begin by Tuesday, the Governor has vowed to appeal and has ordered that no licences are to be issued.

I just can't get my mind wrapped around that. I thought Florida would be the very last (well maybe second last after Utah) to fall. Seems like the states which tried so hard to limit our rights by passing laws banning same sex marriage have put themselves in the most vulnerable positions regarding overthrow of these laws. Life is so ironic ... and beautiful.

The lawsuit just won in Monroe County was filed before a State Judge instead of a Federal Court Judge who only has authority to make judgements for his area, not the entire State as a Federal Judge would.

Today the 10th Circut Court of Appeals (same as Utah) upheld the lower Federal Courts decision to end the ban on marriage equality in Oklahoma.

A stay was immediately issued as appeals to the State Supreme Court or US Supreme Court are expected to be filed very soon.

The ban on same-sex marriage was struck down in Florida again yesterday, this time in Miami/Dade county. The decision was stayed immediately, so Florida like several others will probably be waiting until the US Supreme Court does/doesn't take up the case in 2015.

Does anyone know if there are other States that have to go county by county to get equality?

Yesterday the Alaska Supreme Court gave same-sex couples access to survior benefits...interesting as they do not have marriage equality as of yet.

The Judge said in the decision, that the constitutional ammendment against same-sex marriage that he voters put in place, only says one man/one woman marriage, it says nothing about survivor benefits.

Alaska also ruled a while back, the same-sex couples were elegible for the same property tax exemptions that hetro couples were enjoying.

The 4th Circuit Court of appeals agreed with the lower Court ruling, which said that the same-sex marriage ban voted in for Virgina was unconstitutional.

Marriage is still on hold for another 21 days, or less should an appeal be filed.

On wednesday 8/6, there will be 4 states going to the same Federal Appeals court back to back.

Same-sex proponents and lawyers from Ohio, michigan, tennessee and kentucky will appear before the Federal appeals court in an effort to defend the decisions already made to declare their bans unconstitutional.

Some concern with this court, is that the three panel court has 2 conservatives and one liberal judge. Judge Sutten (appointed by george w) is very conservative, although he did vote in favor of upholding the affordable care act. Also encouraging is the recent string of Judges (liberal and conservative alike) who have ruled in favor of marriage equality.

In any case, win or lose the cases will probably proceed to the US Supreme Court to be determined for the entire country sometime in 2015/2016. In an interview with Supreme Court Justice Ginsburg (from LGBTQ Nation), she stated that the court would take up the issue for a final say so no later than June 2016, possibly sooner.

Today, Utah became the first State to appeal the ruling nullifying it's same-sex marriage ban to the Supreme Court of the United States.

The Court is on Summer recess and will decide whether or not to hear the case when they return in the fall. If the Court says no, then same-sex marriage becomes law in the 10th District Federal Court States. Should they agree to hear the case, it could drag out for 1-2 years, but there will finally be a decision that will be for all States.

Today marks the first time in 14 months that a same-sex ban has been uphelp by a lower court judge.

The judges comment was that neither the federal government nor another state should interfer with a States right to govern itself. Plantiffs will probably appeal to the District court for that area.

It really will be up to the US Supreme Court to decide for all of the country.

On June 25th 2014, oral arguments for a summary judgement against the state marriage ban were held in Federal Court, as of today, no decision has been handed down.

The feeling of most involved, is that the motion will be denied and the case will continue through the courts.

I found another article which said that Hawaii, Idaho and Nevada were the states having cases heard next week.

I was under the assumption that Hawaii had marriage equality already signed into law, so I'll go do some more research.**

Read the decision written by the judge and from what he wrote, I do believe even he realizes his decision probably will not stand up in the higher courts. Didn't come right out and say that but the way a couple sentences are written, sure sounds like it to me. Thanks for keeping us updated!

The 5th Curcuit Court of appeals will hear the appeal of the lower courts decision regarding Louisiana's defeat, as well as the appeal filed by the state of Texas which had it's ban overturned.

Whether or not the bans are overturned, these cases will wind up with the SCOTUS very soon for a final decision.

It's official!

The SCOTUS decided today to add same-sex marriage to their agenda for their first closed door session on September 29th of 2014.

They may not actually hear cases until January, but if so a decision could still be reached by June of 2015.

The SCOTUS listed cases they will hear first, and marriage equality was not amoung them.

They will pass on hearing hundreds of cases early next week, although marriage equality is not expected to be one of those passed on. The Court will again meet 10/10, with cases to be heard announced on 10/14.

If a case is passed on, whatever decision came in the appeals court will stand, as with the challange to standing on prop 8 in California.

I'll keep posting anything i hear for anyone interested.

WASHINGTON - The U.S. Supreme Court on Monday declined to decide once and for all whether states can ban gay marriage, a surprise move that will allow gay men and women to marry in five states where same-sex weddings were previously forbidden.
By rejecting appeals in cases involving Virginia, Oklahoma, Utah, Wisconsin and Indiana, the court left intact lower-court rulings that had struck down the bans in those states. But the high court's action means there will be no imminent national ruling on the issue, with litigation in states where gay marriage is still banned likely to continue.
"Any time same-sex couples are extended marriage equality is something to celebrate, and today is a joyous day for thousands of couples across America who will immediately feel the impact of today’s Supreme Court action," Chad Griffin, president of the gay rights group Human Rights Campaign, said in a statement.
Other states under the jurisdiction of appeals courts that have struck down the bans will also be affected by the Supreme Court's decision, meaning the number of states with gay marriage is likely to quickly jump from 19 to 30. The other states would be North Carolina, West Virginia, South Carolina, Wyoming, Kansas and Colorado.
The court could still take a future case, but its move on Monday is likely to send a strong signal to lower court judges that rulings striking down marriage bans are consistent with the U.S. Constitution.
Gay couples in the affected states may seek to get married immediately, with the chance of chaotic scenes in some parts of the country, because the high court's action means that the appeals court's rulings are no longer on hold.
The high court’s decision not to hear the cases was unexpected because most legal experts believed it would want to weigh in on a question of national importance that focuses on whether the U.S. Constitution’s guarantee of equal treatment under the law means gay marriage bans were unlawful.

The issue could still return to the court, but the message sent by the court in declining to hear the matter would be a boost to gay marriage advocates involved in similar litigation in states that still have bans on the books.
Just over a year ago, the justices ruled 5-4 in June 2013 to strike down a key part of a federal law that had restricted the definition of marriage to heterosexual couples for the purpose of federal government benefits.
That decision in the case U.S. v. Windsor led to a series of court rulings favoring gay marriage in numerous states. In a separate case decided on the same day, the justices sidestepped the broader question of whether state bans violated the U.S. Constitution but allowed gay marriage to move forward in California.
The momentum within America's courts in favor of gay marriage reflects a sea-change in public opinion in the past decade, with polls showing a steady increase in support. Politicians, mostly Democrats but also some notable Republicans, have increasingly voiced their support for ending bans.
It was only as recently as 2004 that Massachusetts became the first state to allow gay marriage following a state court ruling the previous year.
In 17 other states, judges have issued rulings in favor of gay marriage - most of which struck down bans - although the prohibitions have remained intact while litigation continues.
State officials defending their bans counter that the Constitution does not dictate how states should define marriage and that there is no deeply rooted legal tradition that supports a right to gay marriage.

This means that some will be able to marry immediately, and some will still be waiting; i am not surprised that they made this move. This was also the way they handled the question when it came to Californias prop 8, and although eventually they will step in like they did with civil rights for poc, this is probably all we could have expected at this time.

I find it especially heart warming, that since Utah was in such a rush to bring this issue to the SCOTUS in order to hold up same-sex marriage for quite a long time, they will be amoung the 5 that will have to allow marriage immediately. After the interference from the Mormons on prop 8, i find myself almost giddy.

Does anyone have any idea how this will affect other states (like Florida, where I live) whose bans have been found unconstitutional, but where licenses are not being issued pending appeals?

Since SCOTUS has chosen to let pro marriage equality decisions of lower courts stand, could it not be argued that they concur with these decisions, and therefore ALL appeals should be halted and NATIONAL marriage equality established forthwith? (" forthwith" ... ain't that a great word?)

There is no immediate effect to any State except for those 11 previously mentioned.

But.....that is NOT bad news for Florida. Your AG put all lawsuits on hold pending the outcome of the SCOTUS decision, and now your ban (which was overturned at the Federal level) can be taken by the State to the Federal appeals court for the final say.

Should they concur and overturn the ban, it would be pointless (but possible) for them to appeal to the SCOTUS, who just basically said they are ok with marriage equality. Should the State win, the decision will be appealed to the SCOTUS, who will probably take up the question.

Yes Keri i am still giddy, about as giddy as i was devastated by the news that prop 8 passed

with so much help from the Mormons and others. I grieved for a long time, and I'll admit I believe just a little bit in Karma ;)

Just because marriage is becoming widely available, do not fool yourselves into thinking you automatically will receive protection from discrimination; Pennsylvannia comes to mind when i make this warning. Since marriage equality was implemented there, there have been several cases of discrimination which is legal. There is a bill giving protections to LGBT peoples going through their system currently that will bring those protections.

In some states we won the war, but are losing the battle. It is ok to marry, but you can be fired from your job or denied housing for doing so, and it is legal. We have another fight looming, hell it's here looking us in the face...the right for everyone to be protected from those who will descriminate because of whom we love.

In the meantime, be careful out there if you have no protections...having the right to marry is a wonderful thing, but having a job and a roof over your head is also important.

This ruling also paves the way for Montana, Arizona and Alaska which are part of the Ninth District.

I haven't been reading but I'm sure there are many hateful things circulating out there. I'm currently in Oklahoma and never thought in my lifetime that gay marriage would be legal here. I think of this morning, people were already getting married. I sure hope our republican governor is having a lot of anxiety at this time.. she has it coming for sure!


I will probably never get married in this state anyway. I'll save that for when I can go to Vegas and get married by Elvis.

After a day of confusion, Nevada same-sex couples will be allowed to marry as soon as the appeals Judge declares the ban null and void!

All opponents in the State have dropped their appeals.

Soon the need for this thread will be over, and i for one am eternally grateful, as i never thought i would see this in my lifetime.

BUT...as was pointed out earlier, the fight ramps up full force for discrimination protection for our brothers and sisters. Folks, if we can get married but still lose our homes or jobs for being who we are, what have we really gained?

Couples lined up statewide Monday to apply for marriage licenses, beginning the clock on a mandatory three-day wait until ceremonies could be held.
For Kristine Hilderbrand, 30, and Sarah Ellis, 34, it wasn't about being first when they sought and received a waiver to the three-day wait from Magistrate Mary Treiber.
Monday just fit their schedules better.
After completing their marriage license Monday morning, they began to check on available dates for a courthouse ceremony. They then tried to mesh those with their schedules and those of families and friends.
Because Monday was Columbus Day, a federal holiday, members of Ellis' family on the East Coast were able to call into the court's sophisticated teleconference system used for lawyers and defendants spread out over the far-flung judicial district when Treiber conducted the marriage ceremony late Monday afternoon.
Hilderbrand's sister was her maid-of-honor, and her father and nephew also attended. She said Ellis' brother from the Boston area used his thickest New England accent to crack up the room on the speaker phone when he said, "It's wicked awesome that you guys got married."
Alaska helped touch off a national debate 15 years ago with a ban on same-sex unions.
U.S. District Judge Timothy Burgess ruled Sunday that the ban violated the due process and equal protection guarantees of the U.S. Constitution. His ruling came over the objection of gay-marriage opponents who say states should decide the issue, not courts.
Burgess on Tuesday denied the state's request for a stay. Alaska officials plan to appeal his Sunday ruling to the 9th Circuit Court, and could also seek a stay from the appeals court, even though it has allowed gay marriages to go forward in other states within its jurisdiction.
Cori Mills, a spokeswoman for the Alaska attorney general's office, said in an email to The Associated Press on Tuesday that the state has not made a final decision yet whether to ask the 9th Circuit for the stay.
Gay couples married outside Alaska or in ceremonies within the state that didn't carry legal standing were among those seeking licenses.
Barrow offered a unusual small-town setting for Hilderbrand and Ellis' wedding. Barrow has about 4,600 people and is 725 miles north of Anchorage. Many residents lead a subsistence lifestyle, and the landing of three bowhead whales last week provided the passionate discussion, not gay marriage or politics.
"I think the scene is different up here," said Hilderbrand, a third-generation Alaskan who was born in Barrow. Residents accept people for who they are, she said.
"The fact that we're in a relationship together and have been for the last six years in this town, people have just been very accepting and it is just what it is," Hilderbrand said. "It's been such a non-issue here for so long that we were really more focused on getting married and getting to spend the rest of our lives together. We really weren't concerned about all the politics."
What did matter to her, though, was being able to marry in Alaska.
"I didn't want to go someplace else and be married and then come home and have it be a meaningless piece of paper," she said.
Treiber followed this wedding by marrying another lesbian couple at the courthouse. Hilderbrand and Ellis stayed to celebrate the marriage of their friends.
Kelly Cahoon, 28, and Bernice Oyagak, 27, petitioned Treiber for a waiver because they were leaving Barrow for Anchorage on Monday night, and they didn't want to marry in the state's largest city, the Alaska Dispatch News reported.
"It was really kind of special to be able to share the day with them," Hilderbrand said.

I live in Texas, and I wouldn't vote for Greg Abbott if he was the ONLY person running for Governor. I'd write in my own damn name.
He's about as educated as a lab rat. He's all for himself and votes against just about everything that can get him money in his own pockets. He's not for the public, he's selfish and out for his own personal gain.

Anyway, back to the subject at hand.
I had no idea that same sex marriage ban in Texas is the reason I never had kids with prior partners out of wedlock. JESUS H. CHRIST, what a freaking idiot to say that. It hasn't deterred children being born out of wedlock, teens are still on the rise here for getting pregnant and being unmarried.

has ruled Arizona"s ban on same sex marriage to be illegal...

According to the news, the AG will not appeal, and marriages are already happening as there is no waiting period!

The Federal 5th circuit appeals court has scheduled time to hear the cases from Texas and Louisiana on January 5, 2015 (delay much?), in regards to Louisiana upholdng the same-sex marriage ban, and Texas overturning theirs back in September.

The 5th and the 6th Circuit are considered the most conservative of the Federal Courts, and if either side is looking for a way to get the SCOTUS finally involved in a decision for the entire country, it will most likely come after these courts weigh in on marriage equality.

The Federal court overturned the same-sex marriage ban in Kansas today, but stayed the order for a week to give the state a chance to file an appeal, which they have said they will do.

What a waste of taxpayer money!

A Federal Court ruled to overturn the ENTIRE state wide same-sex marriage ban today, but stayed his ruling until appeals could be exhausted. Sooooo to add to the confusion, marriages may continue in St. Louis, as that decision remains valid on its own.

Today, two separate Federal Courts ruled that the same-sex marriage bans in Arkansas and Mississippi were unconstitutional. Both decisions were immediately stayed to allow the states to appeal.

The State courts in Arkansas had previously decided the same thing, and hundreds of people married before the decision was stayed. The Arkansas Supreme Court recently took up the matter, and the State has said that they will abide by their decision, which could happen any day.

Florida's Pam Bondi has filed an appeal with the SCOTUS, asking that the stay on same sex marriage be extended past January 5th, after the Federal appeals court told her no. Clarence Thomas will make that decision within the next few days.

Tennessee has decided that they are very happy since their appeals court upheld the ban on same sex marriage, so they have asked the SCOTUS to stay out of state buisness! Asshats.....

There are now 4 pending cases before the SCOTUS, making it a strong possibility that they will rule on marriage equality before the end of this term.

The last that I heard, most county clerks down here are waiting for further clarification from the judge, as to whether his ruling was meant to apply to all of Florida, or just the county in which the original case was filed. Until that clarification is issued, the word is that most county clerks will NOT be issuing marriage licences.

Like Florida, there are several states still fighting the fight; which makes it that much more critical that the SCOTUS steps up and resolves the question of same-sex marriage one and for all.

A Federal Judge ruled on Thursday (yesterday) that ALL courthouses are required to begin issuing marriage licenses to same-sex couples on 1/6.

At this time, 5 counties have said they will issue the licenses, but in order to avoid having to marry same-sex couples, they will CEASE all marriages at the courthouses.

I think you are pretty safe to color in Florida as of 1/6, as the SCOTUS has refused to extend the stay past that date, and the Federal Court ruled yesterday that all counties must issue licenses.

The Florida Judge who put the stay in place, lifted it today ahead of schedule and marriages have already begun.

Thank you once again for all you have done, for years now, to keep us all in the know about the growing universality of legality of same sex marriages.

Same sex marriages are legal in Florida!!! I am overwhelmed by this, as I never believed it would happen in my life time.

In 1971, in Kalamazoo, Michigan, I was a member of the Gay Liberation Front. We were doing class room information sessions at colleges, and providing speakers for clubs and organizations who would agree to work with us. At that time, homosexual acts were still illegal in many states. Police officers sweeping through a gay bar, arresting all patrons, particularly male patrons, was common. Our brothers and sisters were hauled off to jail, fined or imprisoned. Many lost their jobs and their families. Some lost their lives.

They, and those of us who survived; who marched, protested, voted, wrote letters, opened our hearts to our friends and families, celebrated every little victory, and wept over every little loss, have made much progress. Today I am proud and happy. It is satisfying to know that in some very small way, I contributed to this progress. It is another time to celebrate.

Now there are other things that I dare to hope to live to see happen: Marriage equality in the remaining states, SCOTUS decisions that federalize and confirm this equality, elimination of job. housing, healthcare and all other forms of discrimination against and among LGBTQ folk, etc

This is a happy and blessed day for me. Whether or not you are interested in marrying, Brothers and Sisters, in my state and most others, you are free to make that choice. May it soon be true for all people in all places.

The Respect for marriage act was re-introduced yesterday in both the Senate and the House, by the Democrats and one lone Republican. The Bill was first introduced in 2009, BEFORE the SCOTUS decided on section 3.

Most of DOMA is still in place, and needs to be repealed through the Legislature. With the heavily Republican House and Senate currently seated, there will be slow, if any, progress on the bill.

While I am glad that Senator Feinstein (democrat california) continues to fight for us, I personally feel it will take the SCOTUS to bring marriage to all states, and to put a stop to all of the discrimination allowed in jobs, housing and other areas of importance in our lives.

The Irish Government is putting the issue of same-sex marriage on the ballot for vote this coming May. According to recent polls, nearly 70% of citizens approve of marriage equality.

Canada, England and Scotland currently have marriage equality, while some of the other commonwealth countries like Ireland and Austraila do not.

The throw back without review for Louisiana was expected (at least by me), because the plantiffs tried to bypass the correct steps and go directly to the supreme court.

The review scheduled for this Friday is the important next step, as it could go two ways.

1. Since the bans for Michigan, Ohio, Kentucy and Tennesse were kept in place by the lower courts, and 36 other states HAVE marriage equality, the Justices can decide to hear the cases and possibly rule in the favor of equality.

OR......

2. The Justices can decide that the bans will stay in place for those 4 states, causing mass confusion to ensue.

The cases from last Friday at the Appeals court level (Louisiana, Mississippi and Texas) have been heard and will be ruled on any time in the next few months.

This issue is going to drag on a bit, but will hopefully be somewhat resolved before the end of



the current SCOTUS term which ends in June.

The Justices said they will answer two questions:

1. Do all States have to allow same -sex marriage based on the US Constitution.

2. Do all States have to honor marriages performed in other States and Countries.

Question 1 has come before the court before, and same-sex marriages were not guaranteed by the US Constitution...but we are in a different time, and 36 States now have equality. It is not a slam dunk folks, but i do have hope that the question will be decided in the favor of equality.

I know that the fight to deny all other rights to us will ramp up, every day i read about states trying to write descrimination into law, and it saddens me that the SCOTUS will probably have to decide that question at some other time.

The UK's first same-sex Pagan wedding took place last Sunday in Scotland! The couple has been together for 12 years, and are Hedge Witches.

The Pagan Federation in Scotland has been able to legally marry hetro-sexual couples since 2005, and with new laws for same-sex marriage taking place on 1/1/15, have the right to marry all loving couples.
